HOLD HARMLESS AGREEMENT AND LIMITATION OF LIABILITY
East End Rod and Gun Club (EERGC)

EERGC officials have taken every precaution to ensure your safety during your visit to the facility and shall not be held liable for any act or omission outside its jurisdiction and control or directly related to negligence on the part of an EERGC participant or any other person on the premises of the EERGC range. Steps taken by the EERGC includes the training of range officers, field operators, management staff, members and customers of this facility.

For purposes of this agreement a “participant” may be: an EERGC Member; part of a Member’s household; a Guest of a Member; or just an individual participating in an open event not requiring membership or guest status (participant only).

EERGC participants expressly agree to hold EERGC harmless for any acts or omissions on their part as it relates to: 1) transportation of firearms to and from the facility; 2) handling of firearms; and 3) use of firearms while participating in live-fire events, demonstrations, or training on any of the ranges.

EERGC participants affirm that management has made every effort to instruct them (either through the use of signs, verbal instructions, or written rules) of prevailing safety rules and regulations as a means of ensuring they have a safe, positive and enjoyable visit to the range.

EERGC participants expressly understand that EERGC management reserves the right to refuse access to any person(s) for any reason that might result in a safety violation, damage to the facilities, or who becomes a safety hazard, i.e., they demonstrate unsafe firearm handling practices, a lack of proper training, their use of an unsafe firearm, they become loud, boisterous or disruptive, failure to wear the minimum footwear (sandals), or any other act or omission that is contrary to established criteria, for operating a safe and efficient shooting range.

EERGC participants affirm, by their signature, that they shall refrain from using alcoholic beverages or illicit drugs while on property leased and/or controlled by EERGC. EERGC participants affirm they understand the consumption of alcoholic beverages is expressly prohibited on EERGC property, and that any person(s) under the influence of alcohol or illicit drugs shall be denied access to any part of the facility.

EERGC participants affirm that they alone shall assume full responsibility for their own actions while visiting EERGC range and that participants shall be strictly liable for any injury sustained by their act or omission.

EERGC participants affirm that firearms they will use are free from material defects and function properly, to the best of their knowledge. EERGC participants affirm that ammunition used in their firearm(s) has been properly loaded – either by a licensed manufacturer or, if the ammunition has been hand loaded by themselves, that it was done so by following established criteria as contained in leading reloading manuals; and further that said reloads meet or exceed factory specifications regarding safety.

Nothing in this document shall be construed to mean that EERGC is absolved of its responsibilities and obligations to provide a safe, clean, properly designed, and managed firearms shooting facility.

The undersigned asserts under penalty of perjury: 1) s/he can legally possess a firearm; 2) s/he has no criminal nor mental background that restricts him or her from possession of a firearm; 3) s/he has read, understand, and will comply with the rules and requirements set forth above and on the next page of this document; and 4) s/he agrees to hold East End Rod and Gun Club and its assigns, heirs, directors, members, guests, and volunteers harmless from any act or omission for which s/he is directly responsible.

EERGC members do affirm that firearms they will use are free from material defects and function properly, to the best of their knowledge.

EERGC members affirm that the ammunition they will use in their firearm(s) has been properly loaded, either by a licensed manufacturer or if the ammunition has been hand loaded by themselves that it was done so by following established criteria as contained in leading reloading manuals; and further that said reloads meet or exceed factory specifications regarding safety.

By your signature you affirm that you have read, understand, and will comply with the requirements as set forth herein, and do hereby agree to hold East End Rod and Gun Club, it’s officers, directors, or volunteers harmless from any act or omission for which you are directly responsible.

The undersigned acknowledges that he/she can legally possess a firearm and the he/she has no criminal or mental background that restricts the under sign form such possession under penalty of law or perjury.
